I got a call yesterday from local police. Since we do not have a police chief, it was from some one who I believe wants the job. He read over application that I sent them a copy over 30 days ago.

I live in Hayward, CA.

In his opinion I filled out the application incorrectly. Disposing of firearm constitutes a business and a business is covered under zoning regulations.

My reply was that a business license is a FFL type 01, this is a collector's license 03; which specifically forbids using this license for a business. His reply was that my neighbors would not appreciate me selling guns out of my home and having all that traffic coming and going to my house. And that I would have to have steel doors, steel bars on windows, steel bars over vents. I said that is required for a business and that I do not have an open store front, and I am not operating a business and that I have applied for a collector of curio and relic license. He replied that they have shut down all gun businesses operating out of their homes in the city of Hayward. He did say that he is checking with zoning. But know I am pretty much out of luck.

Zoning is like the local Gestapo. When I applied for a building addition permit years ago, they said my back wall is 6" to close to the fence and I would have to move an existing wall back 6" before I could put on an addition. Man I was blown away, all I could reply was that you approved it back in 1957.

So it looks like I am S.O.L.

I am wondering if I should send back the Collector's license since I cannot now use it.

Now I am wondering if the police are going to come after me for filling out the form incorrectly, since in "their" opinion the collector's license is a business license. Which using the collector’s license as a business is forbidden by the ATF.

I would fight this with an attorney but I do not have the cash resources. I am just a law-abiding blue-collar worker. The whole reason for a collector’s license was to save money.

I wonder how much trouble I am in now, for trying to be a law abiding U.S. citizen?

All I am trying to do is collect firearms. I do not understand why the police think I want to run a gun business. It is not a business license; it is a collector’s license.

Does anyone know of a local firearm ownership friendly attorney in the area?

It’s just in case, to protect my home and family from the local police should they decide to make an issue of the collector’s license.
